There
was a very popular saying among the people of last decade tha they used to
mutter and tried to apply for certain things of their practical life , even the
kids used to do that. Actually I can’t remember whether this saying was
dialogued in a television drama or in an advertisement. Any how the dialogue that Mr. Liynage (
father of Saumya Liyanage) used to act and mutter here is the dialogue ………….‘I know the law putha’ ( son) but let me tell you before I explore this
essay any further ‘ I know no law’ my knowledge about law is less than 10% .
But there are administering body who knows and have learnt according to my
memory of reading apart from the net of courts of the country.
So in
the televised drama or an advertisement, the person tried to prove his awareness
with regard to law and order of the society he lived when ever he does
something, which was to some extent, occasionally became a strange thing for
others. When you live in a society it is true that you need to have some sense
about what is good or bad if not you must at least consult a person who knows bit
of such. I am aware that no shop keeper
can sell out dated household goods to their consumers I don’t know what act
that describes or ‘in what consumer’s code of conduct’ or in what manual that
encloses. And if you buy any garment
from a shop the tag behind the collar or within a garment, normally indicates
that if you are returning that garment purchased or item you need to bring it
back within three days without removing the tag’. And there are some places which displace
‘using mobile phones in this premise is prohibited (?) then you can’t use your
phone. And it is not ethical if others use others phones for their
purposes. Those are minor things that
most people are aware of but if you take big things like contents of
constitutions for example some people have less awareness or no awareness ‘
then what is the duty or responsibility of the subject known’, organize some
awareness programmes within every gama or province for people to get bit of
understanding on the subject.
Like
some scholars pointed out, I believe that if there is any confusion in any of
the society, among people the duty of responsible parties, authorized is to
‘clear their doubts’, clear their confusions.
If we
can’t solve something lets say a dispute in a community, between two families,
we normally go to a nearest police station seeking a ‘solution’, justice.
Why? Because that is one of the
acceptable ways and if you know bit of law then you know what to do if
something similar arises within a society. That is not what you called
‘unnecessary interruption, interference’ though if you consider ‘police is a
second or third part if you take your family as a single and independent unit because
it is written and established in this society since long years now. Normally no
one likes when others interrupting or interfering their p e r s o n a l lives
then you say there is no p r i v a c y , look in this world the letters of
privacy has split and those letters can be seen not together but all over this
space you recognize as ‘ libertyful’ but that is something you need to
understand within a different frame work.
In a society where there is some law and order that the society thinks
should practice things become little different.
This
not a society that everything solve by a panchayak sbha or muladeni, korale
mahaththaya, gampathi of gama or any gam sabha of old admin system of the
country. Everything has changed no matter who established those laws or rules
in the society, other than then rules of the society stay or act, apparent
within a community as Norms and Values.
I do
not know this political kid thinks that we are using the laws and rules that
somebody else has given to us or meant to establish in this society at the
immature stage of applying or using laws from the book of law. Pre – Post
independence, in some stages of admin or political history of this country’s
constitutions changed slightly or added things slightly at various stages due
to what so ever society or political needs of the country. But I believe if you
take the set of law and regulations high percentage of its content is not what
we originally created considering the needs and wants of the society, local. I
believe. So who ever established or introduced some of the laws and regulations
are universally acceptable. What I am trying to emphasize here is that some of
the things needs at least the constitutions should be altered if the things
contain gives the society any confusions or unclearness via what ever sentences
or chapters.
The
regulations or the content of some constitutions for instance about the
regulations, sentences or chapters that explains the ‘characteristics of the
executive presidency’ that according to this political kids memory or knowledge
‘by ex executive president J. R. Jayawardena who was a member of the UNP, the
political party. The decision I believe that the ex president had to take
considering the needs and wants of then society, according to his political or
admin intelligence. That was solely a fresh thing and different to what the country
was practicing by then. I am sure there
were many who opposed and supported to the decision taken by the President J. R
Jayawardena. But since 1977 – 2014 every
government practiced the ‘executive presidency’ introduced by President
Jayawardena (UNP).
If
this political kid’s awareness on political happenings are accurate ‘some of
the chapters or sentences were removed, altered or adjusted within last half a
decade or so. I did not hear or so, perhaps I may not noticed there were no ha
ho about such changes like some screams today about the decision that the
present president of the country Mr. Mahinda Rajapakse deciding to re candidate
for the Presidential election before or after incompletion or completion of
duration allocated by the regulations or rules of the constitution.
So
this political kid thinks that contents of any constitutions can be altered if
that never harms ‘the lives of people of this country’. And if the person knows
how to use the tools given to him, if you consider executive presidency is a
tool not a weapon then there is no reason to be afraid.
I
believe that it is a good decision taken by the government to get advise from
the country’s reputed, prideful institution that so far shown and proved ‘
justice is justice’ to their country people. And this occasion of confusion the
people of this country can expect their decision or advice on ‘current
president deciding to face the presidential election for the third time. I
think that decision of justice system is already released (?) and the whole
country by now is aware of the decision, except me?
What
ever decision that the court released or will be releasing ‘respecting that,
the country must proceed. The parties can continue their things and citizens
can decide on their vote. Like this political kid always says ‘the decisions is
on the brains of the citizens of this country.
The Jury is the people of this country, if you try to equalize ‘an
election an appeal of somebody, in other words. After the election the jury = people will send
you home the result sheet of their decision after what so ever number of
discussions.
Let’s
respect the jury of all type, levels. There are some organs called ‘thinking,
analyzing , measuring or weighing machines within human’ that understands bit
of what is good or bad’, thankfully.
The note
of today; I could not post the above essay yesterday. The news that I heard today is that the decision
of the court is expected to be released tomorrow. I believe that we all must
send our thanks to the scholars who thought of contributing their knowledge by
giving their opinions on behalf of the citizens of this country. I don’t think that
there is a huge gap between, the responsibilities, duties of professions and
yes the rights of some professions.
